Man sentenced to 90 days of house arrest in rape of 5-year-old girl



The victim was just 5 years old when she was assaulted, said family attorney Kenneth Meleyco. The attorney said it happened after Burgess invited the family to his Calaveras County cabin back in 2016.

The girl’s father had known Burgess for two decades.

"They trusted this man, he was a family friend, and he took advantage of them," Meleyco said.


After Wednesday’s hearing, defense attorney Gregory Davenport said his client still maintains his innocence. He told the Stockton Record he believes the allegations against Burgess “are motivated by greed.”

Burgess founded Rare Parts Inc. in 1981 -- an automotive parts manufacturer and distributor.

May have had something to do with the fact that he is 79 years old and may no longer have all his marbles. No excuse though. One would have to wonder if when he was 77 if the evidence would have still stood up in court. Everything about this story does not ring true.

Back when I was much younger, a good friend cautioned me about trying to date OR being alone with a female younger than 18 years old. Seems that IF the father desired, he could file "statutory rape" charges if he desired, due to her "below 18" age. Even if no sexual activities were involved, in ANY manner. Just being alone in the same place/same time was enough. Seems the girl's father filed such charges against a friend of his as the father didn't like the guy being friends with his daughter.

NOT to question the accusers, but there have been many times when a younger female made these charges against an older person when nothing happened. My female cousin was babysitting two young girls (she was in college) and one claimed she was "abused". Went to court trial and all, before the young girl recanted her story. This was in the '80s when many similar allegations were being done by younger children against older people. AND, in each case, the "experts" claimed the allegedly abused child displayed the signs of what they claimed had happened. Seems the young accusers didn't like being told not to do something, then sought a way to get back at the older person, so "abuse" or being mistreated was what the child told their parents. The younger child wanting attention usually played into the situation somewhere, typically.

Therefore, knowing what my cousin went through and the many other reported recanted allegations back then, I look at these things with a more jaded orientation. As bad as it would be IF it really happened, without solid physical evidence that it really did happen, I tend to suspect that few parents would want to subject their young daughter to the physical examinations and "rape kit" evidence collection. Those issues might have led to the "statutory" situation rather than a full rape conviction. Not to forget the "younger and older" issues I mentioned above.

As "wide" as the term "rape" seems to now be defined, much less "abuse", things are not what many of us grew up knowing about. "Rape" doesn't mean that a male's body part violated a female's body area. It can be fingers or other objects instead. Things aren't what they used to be.

I have NO interest in that company, the individuals involved, or any other aspect of the accused person. Just relating my reactions to the newspaper article.

And by all accounts, he is in poor health and maybe he just wants to die in peace. Let the vampire lawyers fight over the estate, that is the American way. The homely feminist types will no doubt rejoice, they can can get a rape conviction when no such thing even happened.

As someone who has lived first hand with the end results of this type of predatory abuse sadly "TWICE" !!! from where I'm sitting.............
